Terms of Service

These Terms of Service (the "Terms") govern your access to and use of omni-gemini.ai and the Gemini Omni AI video and image generator (the "Service"). By creating an account or using the Service you agree to these Terms.

1. Eligibility & Accounts

You must be at least 13 years old (or the higher age required by your jurisdiction) to use Gemini Omni. You are responsible for activity on your account, for keeping your credentials secure, and for ensuring the information you provide to Gemini Omni is accurate.

2. Plans, Credits, and Billing

Gemini Omni offers monthly subscriptions, yearly subscriptions, and one-time credit packs. Credits are consumed when you run a generation. Payments are processed by Stripe and (where applicable) PayPal.

• Subscriptions renew automatically until canceled. You can cancel from inside your account at any time; access continues through the end of the paid period.
• Credit packs are one-time purchases — credits do not expire until the period stated on the pack at the time of purchase.
• Plan changes take effect at the start of the next billing cycle unless otherwise stated.
• Refunds are reviewed case by case under applicable consumer-protection law and the policy posted in your Gemini Omni account.
• Taxes may be added by the payment processor based on your billing jurisdiction.

3. Acceptable Use

You agree not to use Gemini Omni to generate, upload, or distribute content that:

• Sexually depicts a real identifiable person without their explicit consent, or that depicts minors in any sexualized context.
• Targets a real person with non-consensual face, voice, or likeness cloning for harassment, defamation, or fraud.
• Generates voiceprints or biometric impersonations intended to impersonate a specific individual without consent.
• Promotes terrorism, mass violence, self-harm, or imminent physical danger to others.
• Constitutes Child Sexual Abuse Material (CSAM) or grooming.
• Violates intellectual-property rights, including by reproducing copyrighted material at a length or fidelity that exceeds fair use.
• Spreads disinformation about elections, identifiable public officials, or public-health matters in ways designed to deceive.
• Bypasses, disables, or interferes with safety features, watermarks, provenance signals, or rate limits in Gemini Omni.
• Reverse-engineers Gemini Omni, scrapes the Service, or uses the Service to train competing models.

We may suspend or terminate accounts that violate these rules.

4. Ownership & Commercial Rights

You retain ownership of the prompts and reference assets you submit to Gemini Omni. Outputs you generate are yours, subject to your compliance with these Terms and the underlying rights of any third-party references you submit.

Every output produced under a paid Gemini Omni subscription or paid credit pack carries full commercial usage rights — advertising, publishing, broadcast, client deliverables, and print — for the entity that paid for the plan. A signed commercial license PDF is available for download inside your account at /commercial-license.

Outputs you generate without an active paid plan are licensed for personal, non-commercial use only.

5. Provenance & Watermarking

Every Gemini Omni clip ships with invisible provenance metadata for AI traceability. You agree not to alter, strip, or attempt to circumvent provenance signals in Gemini Omni outputs.

6. Third-Party Models & Infrastructure

Gemini Omni routes requests to underlying model and infrastructure providers (for example, hosting, payment, analytics, and inference partners). Their availability, performance, and quality may vary. We use reasonable efforts to keep the Service reliable but do not guarantee uninterrupted access.

7. Disclaimers

The Service is provided "as is" and "as available". Gemini Omni does not warrant that outputs will be accurate, fit for any particular purpose, free of bias, or free of error. You are responsible for reviewing outputs before publication.

8. Limitation of Liability

To the maximum extent permitted by law, Gemini Omni and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data. Our aggregate liability for any claim arising out of or related to the Service will not exceed the amount you paid to Gemini Omni in the twelve months preceding the event giving rise to the claim.

9. Indemnification

You will defend, indemnify, and hold harmless Gemini Omni and its affiliates from any claim, loss, or expense arising from (a) your use of the Service, (b) outputs you publish or distribute, or (c) your breach of these Terms.

10. Termination

You can stop using Gemini Omni at any time by deleting your account. We may suspend or terminate your account for violations of these Terms, for unpaid amounts, or if required by law. Sections covering ownership, commercial rights, provenance, disclaimers, limitation of liability, and indemnification survive termination.

11. Changes to the Terms

We may update these Terms from time to time. The "Last updated" date indicates when the most recent changes took effect. Material changes will be announced inside Gemini Omni or by email. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction where Gemini Omni is established, without regard to conflict-of-law principles. Mandatory consumer rights in your country of residence still apply.
